Purchase Agreement for Member Services
IMPORTANT - READ THESE TERMS CAREFULLY BEFORE JOINING UP AS A FREE MEMBER OR PURCHASING A PAID MEMBERSHIP, TO USE ANY OF THE CONTENT OF THIS WEBSITE. THE TERMS INCLUDE THE "TERMS OF USE", THE "PRIVACY POLICY" AND THE "EARNINGS DISCLAIMER" ALL OF WHICH FORM PART OF THIS AGREEMENT AND THE LINKS TO WHICH ARE AT THE BASE OF OUR WEB HOME PAGE. IF YOU DO NOT AGREE TO THE TERMS AND CONDITIONS OF THIS AGREEMENT, DO NOT CLICK THE "ACCEPT" BUTTON AS REFERRED TO ABOVE AND YOUR MEMBERSHIP AND / OR PURCHASE WILL NOT PROCEED.
1.) Agreement: This Agreement is between Oze Racing Review (ORR) and yourself, as either as a member or purchaser or both (you, your) and is made subject to the laws in the State of New South Wales. You agree to be bound by the terms of this Agreement, including all of its parts as stated.
2.) Content: The content and material on this website is proprietary information owned by ORR and is copyright material. As a member (free or paid) you are granted the non-exclusive use of the content and material for your own individual personal use, information and entertainment. You are not to use it for any commercial purposes and have no ownership rights. You agree not to copy, modify, use, distribute or display any of the content or materials to any third party whatsoever.
3.) Warranty: ORR provides this content and materials without any warranties of any nature whatsoever, express or implied, including any merchantability of fitness for any purpose. In no event, shall ORR, its principals, agents, associates, contractors or employees, be liable for any loss or losses of any nature, or for any indirect, special or consequential losses or damages, arising from or relating to the use or misuse of any content or materials on this website.
4.) Membership: A Silver (free) membership is offered from time to time, renewable on an annual basis and a Gold (paid) membership is offered from time to time on a monthly subscription, the cost of which is advised at the time of purchase. Other forms of membership may be offered from time to time. There is no obligation whatsoever on ORR to offer any particular form of membership at any particular time and all membership offers may be withdrawn at any time, without any notice and without any recourse. Membership acceptance is at the sole discretion of ORR.
5.) Refunds: Any paid membership subscription offered from time to time by ORR is subject to a 30 day money back guarantee from the date of purchase and / or acceptance by ORR. You may obtain a refund by notifying ORR within the period stated and cancelling your membership. ORR will promptly issue a full refund. No other refunds are offered after the expiry of the 30 day period.
6.) Cancellation: You may cancel your membership (free or paid) at any time. Cancellation may be by notice or email. ORR may cancel your membership (free or paid) at any time, without reason or notice and without any recourse by you. Any paid membership by you is automatically cancelled if the subscription fee is not paid on the due date and ORR is not obliged to provide any notice.
7.) Relationship: You agree that you have no relationship with ORR, other than of a purchaser or member of this site where ORR is the vendor, providing such service as it may offer from time to time in accordance with this Agreement.
8.) Privacy: ORR has a Privacy Policy, which you agree you have read, understand and which forms part of this Agreement and which there is a link to at the base of the ORR home page.
9.) Terms: ORR has a Terms of Use (Service) , which you agree you have read, understand and which forms part of this Agreement and which there is a link to at the base of the ORR home page.
10.) Disclaimer: ORR has an Earnings Disclaimer Statement, which you agree you have read, understand and which forms part of this Agreement and which there is a link to at the base of the ORR home page.
11.) Minimum Age: To join as a member (free or paid) of ORR, you MUST be a minimum of eighteen (18) years of age. By agreeing to these terms and acknowledging same on the Registration Form, you are hereby certifying that you are eighteen (18) years of age, or older, on the day you submit the Registration Form for membership.
12.) Indemnity: You agree that unauthorised use of any part of the content provided would cause irreparable injury to ORR, for which money damages may be inadequate and ORR shall have the right to seek such remedy or relief as it may deem appropriate. Nothing contained in this Agreement shall be construed to limit such remedies.
13.) Term: This Agreement shall remain in force between the ORR and you, for as long as you are a member (free or paid). In this respect, nothing herein shall be construed as reducing or diminishing any rights or remedies that ORR may have, whether or not you are a member and ORR reserves all of its rights.
14.) Performance: ORR is under no obligation whatsoever to provide any or all of the content or services that may from time to time be advertised or provided by it and ORR, may at its sole discretion reduce, modify, amend, discontinue or change any content or service or part thereof, without notice and you agree that you shall have no recourse, other than that of cancellation of membership as stated herein. Any unused portion of any paid membership, shall be refunded at the sole discretion of ORR.
15.) Complete Agreement: This Agreement, including its parts as stated herein, constitutes the sole agreement between ORR and you and supersedes all previous agreements or understanding whether written or oral.
16.) Governing Law: This Agreement is made in the State of New South Wales and governed by the laws thereto.
